BY ENTERING YOUR "SHOW US YOUR JOE" PHOTOGRAPH, YOU AGREE TO THESE OFFICIAL RULES, WHICH CREATE A CONTRACT SO READ THEM CAREFULLY. WITHOUT LIMITATION, SUCH CONTRACT INCLUDES GRANTS OF RIGHTS AND INDEMNITIES TO THE SPONSOR, FLANIGAN'S ENTERPRISES, INC., ("FLANIGAN'S"), FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

Photographs for the first monthly contest will be accepted beginning at 12:01 a.m. Eastern Standard Time on September 1, 2010 and ending at 11:59 p.m. Eastern Standard Time on September 30, 2010. Photographs for subsequent monthly contests will be accepted beginning at 12:01 a.m. Eastern Standard Time on the first day of the month and ending at 11:59 p.m. Eastern Standard Time on the last day of the montly "Monthly Contest" or collectively "Monthly Contests"

Monthly Contests may be terminated by Flanigan's at any time, without prior notice.

1. Monthly Contests are open to individuals who are at least eighteen (18) years of age as of the date of entry, ("Entrant"). No purchase is necessary, but internet access is required. Employees of Flanigan's, its subsidiaries, franchises and limited partnerships and their immediate family members are not eligible to participate or win. For purposes hereof, "immediate family members" are defined as spouse, domestic partner, legal guardians and any children eighteen (18) years of age or older who are living with the employee. This contest is void where prohibited or restricted by law.

2. To enter, submit a photograph of your favorite "Joe Cup" picture via e-mail to www.flanigans.net and click on "Show Us You Joe". Directions for e-mailing photographs are provided on this website. Photographs should not be larger than 10 MB in size and must be submitted via jpeg, pdf or bmp format. Normal internet access and usage charges imposed by the Entrant's online service provider will apply. By submitting a photograph, Entrant agrees to these Official Rules.

3. By entering, Entrant represents, acknowledges and warrants that the submitted photograph is an original work created by Entrant and that no other party has any right, title, claim or interest in the photograph. Altered images are acceptable.

4. Each photograph that includes identifiable subjects (persons) must be accompanied by a separate, signed release from each identifiable subject in the photograph. Releases that cannot be verified for authenticity by Flanigan's, for any reason (including missing, incorrect or incomplete contact information on the release form) will result in the disqualification of the photograph. You must upload a signed release when submitting any image containing any identifiable people.

5. All photographs submitted become the property of Flanigan's and will not be returned. There is no limit on the number of photographs each Entrant may submit, but duplicate submissions will automatically be disqualified. For purposes of entering this contest only, Flanigan's grants the Entrant a non-exclusive, limited license to use its federal trademarks, "Flanigan's Seafood Bar and Grill" and the "Head" of its founder, Joseph G. Flanigan. Entrant may not use Flanigan's trademarks for any other purpose whatsoever without the express written consent of Flanigan's.

6. Photographs must be in keeping with Flanigan's public image and may not be obscene, profane, lewd or otherwise offensive, as determined by Flanigan's in its sole discretion, nor can they defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe (or may infringe) upon any copyright, trademark, logo, mark that identifies a brand or any person's personal or proprietary rights. In such an event, the photograph will be disqualified.

7. Failure to provide true and accurate information will automatically disqualify the Entrant. This contest is subject to federal, state and local rules and regulations.

8. Immediately following the conclusion of a Monthly Contest, the eligible photographs will be judged by a panel of Flanigan's selected judges, based upon which photograph is considered the most unique, bizarre or extraordinary "Joe Cup" picture. No information regarding entries or judging, other than as provided in these Official Rules, will be disclosed. Decisions of the judges are final with respect to all matters relating to this contest.

9. Each Monthly Contest winner will receive a $100 Gift Card which may be redeemed at any "Flanigan's Seafood Bar and Grill" restaurant owned and/or operated by Flanigan's or its franchisees. Locations of 'Flanigan's Seafood Bar and Grill" restaurants are provided on this website. Each Monthly Contest winner will be notified at the e-mail address associated with the account used at time of submitting his/her photograph and will be required to provide his/her mailing address in order to receive his/her prize. Return of any prize or prize notification as undeliverable or the failure of the Entrant to claim his/her prize within thirty (30) days of notification may result in disqualification of the photograph and the determination of an alternate winner.

10. Submission of a photograph in the contest grants to Flanigan's, its subsidiaries, franchisees, limited partnerships and affiliates, Entran's irrevocable permission to use the photograph or digital file submitted by the Entrant, his/her name and city for promotional and advertising purposes in any media without further compensation or notice, except where prohibited by law and to sign any documentation required by Flanigan's to effect or perfect such license. Each winner represents that he/she has all the rights necessary to grant this license. If the winner of any Monthly Contest is a "minor", meaning he/she is under the age of majority in his/her state of residence, (which is eighteen (18) years of age in most states, including Florida), then his/her parents or legal guardian must execute and return an affidavit of eligibility and liability/publicity release (where legal) on behalf of the winner within ten (10) days of the notification attempt or the prize will be forfeited and an alternate winner determined.

11. Flanigan's, its subsidiaries, franchisees, limited partnerships and affiliates are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the contest or by any human error which may occur in the contest. Flanigan's also reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of Flanigan's website, violates the Official Rules or acts in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten or harass any other person.

12. By entering, Entrants release and hold harmless Flanigan's, its subsidiaries, franchisees, limited partnerships and affiliates, as well as any directors, officers or employees of those organizations from any and all liabilities for any injuries, loss or damage of any kind arising from or in connection with this contest, including reimbursement of reasonable attorney's fees and costs, including appeal.
